These Terms and Conditions ("Terms") govern your access to and use of the TaxiBy web application, mobile application, website, and related services (collectively, the "Platform") provided by TaxiBy Technology ("TaxiBy", "we", "us" or "our"), a company incorporated under the laws of India.
By accessing or using the Platform, or by booking, accepting, or providing any ride through the Platform, you agree to be bound by these Terms.
TaxiBy operates as a technology platform that enables passengers to connect with independent third-party drivers who provide transportation services using their own vehicles. TaxiBy does not own, operate, control, or manage any vehicles. TaxiBy does not employ drivers and does not directly provide transportation services. All transportation services are provided directly by independent drivers who are solely responsible for operating their vehicles, complying with applicable laws, maintaining valid licences, permits, and insurance, and providing transportation services to passengers.
To support safe and reliable rides, TaxiBy performs document verification and onboarding checks for drivers and vehicles before allowing them to use the Platform. This may include verification of driving licences, vehicle registration certificates, insurance documents, and other relevant records in accordance with applicable guidelines. However, such verification does not constitute an endorsement, guarantee, or assumption of liability by TaxiBy for the conduct of drivers or the quality of transportation services provided.
1. Definitions
- "Booking": means a request for transportation services submitted through the Platform.
- "Driver": means an independent third-party driver registered on the Platform to provide transportation services.
- "Passenger" or "User": means any individual who accesses or uses the Platform to book or undertake rides.
- "Corporate Client": means a registered business entity whose authorised employees use the Platform for transportation services.
- "Ride": means the transportation service provided from the pickup to the drop-off location.
- "Service Fee": means the technology platform fee charged by TaxiBy for facilitating the connection, dispatch, tracking, payment processing, and support services.
2. Eligibility and Accounts
You must be at least 18 years of age and legally competent to enter into contracts to use the Platform.
You agree to provide accurate, current, and complete information during registration and to update such information promptly if it changes. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
TaxiBy reserves the right to suspend or terminate any account for violation of these Terms, suspected fraud, or any other reason deemed necessary to protect the integrity of the Platform.
Corporate Clients must provide accurate company details, GSTIN (where applicable), billing address, and a list of authorised users. Corporate Clients remain fully responsible and liable for all Bookings made under their account, including those by their authorised employees.
3. Bookings and Transportation Services
All Bookings are subject to the availability of Drivers. TaxiBy does not guarantee the availability of transportation services at any time or location.
Passengers must be present at the designated pickup location within the standard waiting period. Waiting charges apply thereafter at the rate specified in the application.
The estimated fare displayed before confirmation includes base fare, distance and time charges, applicable waiting charges, tolls, parking (at actuals), night surcharge (where applicable), and taxes. The final fare may vary depending on actual distance travelled, trip duration, route taken, traffic conditions, and other operational factors.
TaxiBy does not guarantee the safety of rides, and passengers are advised to verify driver identity, vehicle details, and share ride details with trusted contacts where necessary.
Drivers have the right to refuse any Booking or request to alter the route if it involves a violation of traffic rules, safety concerns, or illegal activities.
Maximum occupancy is limited to 4 adult passengers per standard vehicle unless otherwise specified. Overloading is prohibited.
TaxiBy shall not be liable for failure or delay in performance due to events beyond reasonable control, including natural disasters, strikes, government restrictions, technical outages, or network failures.
TaxiBy does not guarantee uninterrupted availability of the Platform and may temporarily suspend services for maintenance or technical updates.
TaxiBy may maintain a passenger and driver rating system to improve service quality. Consistently low ratings may result in account review or suspension.
4. Payments and Fees
The Passenger or Corporate Client shall pay the final fare as displayed or calculated in the application or by our team via phone call, along with any applicable tolls, parking charges, waiting charges, night surcharge, and statutory taxes (including GST).
Payments may be made via cash, UPI, credit/debit cards, digital wallets, or through monthly invoicing for Corporate Clients as per the agreed credit terms.
Any disputes regarding the fare must be reported within 48 hours of completion of the Ride through the application or by contacting support@taxiby.in, failing which the fare shall be deemed accepted.
TaxiBy charges a Service Fee for use of the Platform technology, real-time tracking, automated dispatch, customer support, and related services. This fee is deducted from the amount collected from the Passenger and is not part of the Driver's earnings.
TaxiBy reserves the right to investigate and take appropriate action against fraudulent activity, including fake bookings, payment fraud, misuse of promotions, or manipulation of the platform.
TaxiBy may apply dynamic pricing or surge pricing during periods of high demand, adverse weather conditions, special events, or limited driver availability. Such pricing will be displayed prior to ride confirmation, where applicable.
5. Driver Onboarding Fee
TaxiBy may charge a one-time onboarding fee from drivers registering on the Platform. The current onboarding fee is subjective. It covers onboarding accessories and driver account activation.
The onboarding fee is a one-time, non-refundable fee applicable during driver registration.
6. Cancellations
Cancellations by Passengers within the free cancellation window (generally 2 minutes after Driver acceptance) incur no charge. Thereafter, a cancellation fee applies to compensate the Driver for time and opportunity lost.
If a Passenger fails to appear at the pickup location within the allotted waiting time without prior cancellation, a no-show fee may apply.
Drivers must maintain a low cancellation rate. Repeated unjustified cancellations may result in penalties or suspension of the Driver's account.
7. User Conduct
Passengers shall:
- Behave courteously and respectfully towards Drivers.
- Refrain from smoking, consuming intoxicants, littering, soiling, or damaging the vehicle or any equipment therein.
- Do not carry illegal, hazardous, or prohibited items.
- Not request or compel the Driver to violate traffic laws, speed limits, or any applicable regulations.
- Not harass, abuse, or discriminate against Drivers.
Violation of these obligations may result in additional charges for cleaning or repair, suspension or termination of the account, and/or reporting to appropriate authorities.
Drivers shall maintain professional conduct, ensure the vehicle is clean and roadworthy, comply with all traffic and transport laws, and refrain from consuming alcohol or intoxicants while providing services.
8. Lost Property and Complaints
Passengers are responsible for their personal belongings. In case of lost items, passengers must report the matter through the application within 24 hours. TaxiBy shall coordinate with the Driver on a best-effort basis but assumes no liability for loss, damage, or non-recovery of items.
Any complaints regarding the Ride, Driver conduct, or service quality must be submitted in writing through the application or email within 24 hours of the Ride.
9. Limitation of Liability and Disclaimers
The Platform and services are provided on an "as is" and "as available" basis. TaxiBy disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted or error-free operation, or that the services will meet your requirements.
Without prejudice to the foregoing, TaxiBy makes no representation or warranty that:
- The services will meet the Passenger's or User's requirements.
- The services will be uninterrupted, timely, secure, and error-free.
TaxiBy shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from use of the Platform or services, including but not limited to loss of profits, data, goodwill, personal injury, property damage, accidents, delays, failure to provide services, or any conduct of Drivers or third parties.
TaxiBy is not responsible for missed flights, trains, buses, or other connections. Passengers should allow sufficient buffer time.
In no event shall TaxiBy's aggregate liability exceed the amount of the Service Fee or fare paid for the relevant Ride.
10. Indemnity
You agree to indemnify, defend, and hold harmless TaxiBy, its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform, violation of these Terms, or any negligent or wilful act or omission by you or your authorised users.
11. Termination
TaxiBy reserves the right to suspend or terminate your access to the Platform or any services at any time, with or without cause or notice, including for breach of these Terms, non-payment, fraudulent activity, or safety concerns.
You may discontinue use of the Platform at any time by deleting your account, subject to settlement of any outstanding amounts.
12. Data and Privacy
Your use of the Platform involves the collection of location data, contact information, ride history, and device details for purposes of service provision, safety, fraud prevention, and improvement of services. TaxiBy processes personal data in accordance with its Privacy Policy (available at TaxiBy.in/privacy) and applicable laws, including the Digital Personal Data Protection Act, 2023.
Location-based information may be shared with Drivers solely to facilitate the Ride. Call recordings and GPS tracking are used for quality, training, and security purposes.
13. Driver Terms (Applicable to Registered Drivers)
Drivers are independent contractors and not employees of TaxiBy. Drivers must provide a valid driving licence, vehicle registration certificate, insurance, fitness certificate and commercial permits (where required). TaxiBy may verify documents and deactivate accounts for non-compliance.
Drivers receive earnings net of Service Fee, applicable taxes, and any deductions for violations. Payouts occur as per the defined cycle.
Drivers must maintain high performance standards, accept trips in good faith, and adhere to conduct rules. Repeated low ratings, complaints, or violations may lead to suspension or deactivation.
Drivers shall not solicit passengers for off-platform transportation services for the purpose of avoiding the TaxiBy Service Fee. Repeated violations may result in suspension or permanent deactivation.
14. Amendments
TaxiBy may amend these Terms at any time. Amended Terms will be posted on the Platform with the effective date. Continued use of the Platform after such posting constitutes acceptance of the amended Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Coimbatore, Tamil Nadu.
Parties agree to attempt amicable resolution before escalating to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Coimbatore.
16. Miscellaneous
These Terms, together with the Privacy Policy, constitute the entire agreement between you and TaxiBy regarding the Platform and supersede all prior understandings.
If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

The above mentioned terms and conditions of use and the Privacy Policy constitute the entire agreement between the User(s) and TaxiBy with respect to access to the use of the website and the Services offered by TaxiBy, superseding any prior written or oral agreements in relation to the same subject matter herein.
